Background of the Insolvency
The journey to insolvency for Xalta Food and Beverages began over seven years ago. The National Company Law Tribunal (NCLT), New Delhi Bench, admitted the company into the Corporate Insolvency Resolution Process (CIRP) on July 25, 2018.
The case was initiated by an operational creditor, Super Print Services, a sole proprietorship of Mr. Nand Kishor Gautam. The printing firm had supplied various promotional materials like posters, umbrellas, banners, and T-shirts to Xalta on a continuous basis. Despite raising invoices totaling over ₹5.65 lakhs between December 2016 and February 2018, their payments remained outstanding.
After repeated follow-ups, Xalta Food and Beverages formally admitted its liability and confirmed the debt. Following the mandatory legal procedure, a demand notice was served under the Insolvency and Bankruptcy Code (IBC) in May 2018. With the corporate debtor failing to pay and openly admitting its inability to liquidate the dues due to a “financial crunch” before the NCLT, the tribunal ruled in favour of the operational creditor.
The NCLT bench, comprising Member (Judicial) Smt. Ina Malhotra and Member (Technical) Smt. Deepa Krishan, admitted the petition and declared an immediate moratorium on the company. Mr. Naveen Kumar Jain was appointed as the Interim Resolution Professional (IRP) to manage the company’s affairs and oversee the resolution process.
