3,000 homebuyers submit Rs 3,192 cr claims against Ansal Properties and Infrastructure

Around 3,000 homebuyers have submitted claims of Rs 3,192 crore under the corporate insolvency resolution process of Ansal Properties and Infrastructure Ltd. Of the Rs 3,192 crore claims, the interim resolution professional has so far admitted claims worth only Rs 1,154 crore. Around Rs 750 crore homebuyers claims have not been admitted while the rest is still under verification.

The company made the said announcement in an exchange filing on 5 January 2023.

So far, a total of claims worth Rs 6,276 crore have been made by different creditors of Ansal Properties and Infrastructure. Of the total claims made, the interim resolution professional has admitted only Rs 2,742 crore worth of claims, Rs 805 crore claims have been rejected and the rest is under verification.

The homebuyers are the biggest creditors in the CIRP of Ansal Properties and Infrastructure, followed by 12 banks and financial institutions who have together submitted Rs 1,045 crore worth of claims. So far, the interim resolution professional has admitted Rs 807 crore claims of the financial creditors. The rest is under verification. Indian Bank has the biggest exposure to Ansal Properties and Infrastructure with Rs 341 crore claims. IL&FS and Canara bank with Rs 104 crore and Rs 102 crore are the other two financial institutions with significant exposure in the company.

Apart from them 288 deposit holders have also submitted Rs 16.9 crore claims.

The insolvency petition against the Ansal Properties and Infrastructure was filed by 126 homebuyers, whom the real estate company has not delivered the flats they booked in one of its Gurgaon projects called The Fernhill.

The homebuyers had booked their flats in 2011, and the builder had promised to handover the flats by July 2017. But according to the homebuyers who submitted the insolvency plea, Ansal Properties had not been able to complete the project even by March 2021.

The 126 applicants had together paid Rs 53.5 crore to the builder for booking flats in the said project.

The homebuyers have also alleged the builder of diverting the money collected for the projects to another project – Samyak Projects and Infrastructure Ltd.

The New Delhi bench of the NCLT admitted the plea against Ansal Properties and Infrastructure on 16 November 2022 and appointed Ashwani Kumar Singla as the interim resolution professional.
